Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FloristsChoice platform ("Service") operated by Florist's Choice ("we", "us", or "our"). By registering an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding agreement on behalf of yourself or the business you represent. By using the Service, you confirm that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at hello@floristschoice.com if you suspect unauthorized access.

Each subscription covers a single business (tenant). Sharing access credentials between multiple businesses is not permitted.

3. Subscription and Billing

The Service is provided on a subscription basis. Fees are charged in advance on a monthly or annual basis depending on your selected plan. All payments are processed securely by Stripe.

You authorize us to charge your payment method on a recurring basis. Subscriptions auto-renew unless cancelled before the renewal date. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.

Prices may be updated with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4. Taxes

Prices shown may be exclusive of applicable taxes. Tax amounts are calculated based on your billing address and are displayed at checkout. You are responsible for providing an accurate billing address and, where applicable, a valid tax ID.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Upload or transmit malicious code, spam, or content that infringes third-party rights.
• Resell, sublicense, or otherwise transfer your access to the Service without our written consent.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Florist's Choice. Your content (recipes, arrangements, business data) remains your property; by uploading it, you grant us a limited license to store and process it solely for the purpose of providing the Service.

7. Availability and Modifications

We strive for high availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where possible.

8. Termination

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or engage in activity that harms the Service or other users. You may terminate your account at any time. Upon termination, your data will be retained for up to 90 days per our Data Retention Policy, then permanently deleted.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Florist's Choice shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service.

11. Governing Law

These Terms are governed by applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a notice within the platform. Continued use of the Service after changes constitutes acceptance of the revised Terms.
